The Colorado Medical Board (CMB) was instituted as part of the Medical Practice Act for the purpose of regulating and controlling the practice of healing arts, which include establishing and enforcing the licensing standards for Medical Doctors (M.D.s), Doctors of Osteopathy (D.O.s), Physician Assistants (P.A.s), and Anesthesiology Assistants (A.A.s). Licensure is mandatory to practice medicine in Colorado or to treat Colorado patients. Exceptions exist for the Veterans Administration, Bureau of Indian Affairs, and Department of Defense physicians and other licensed healthcare providers.

The CMB investigates the unlicensed practice of medicine, however, it does not have authority to arbitrate or adjudicate fee disputes. The decisions made by the CMB are not subject to administrative review. The CMB is a Type I Board, meaning that it is policy autonomous and comprised of professional and public members (eight M.D.s, three D.O.s, two P.A.s, and four public members).

What is this about?

The Colorado Medical Board (“Board”) is requesting written comments regarding proposed revisions to Rule 1.9 - DEMONSTRATION OF CONTINUED COMPETENCY BY PHYSICIAN ASSISTANT APPLICANTS FOR LICENSURE, LICENSURE PURSUANT TO THE OCCUPATIONAL CREDENTIAL PORTABILITY PROGRAM, REINSTATEMENT OF AN EXPIRED LICENSE, OR REACTIVATION OF A LICENSE and Rule 1.14 - FINANCIAL RESPONSIBILITY STANDARDS, to implement Senate Bill 23-083 (CONCERNING AN EXPANSION OF A PHYSICIAN ASSISTANT'S ABILITY TO PRACTICE, AND, IN CONNECTION THEREWITH, CHANGING THE RELATIONSHIP BETWEEN A PHYSICIAN ASSISTANT AND A PHYSICIAN OR PODIATRIST FROM SUPERVISION TO COLLABORATION).

The Board will hold a Rulemaking Hearing on May 23, 2024, at 9:00 a.m., to determine whether to adopt the proposed revisions to Rules 1.9 and 1.14 on a permanent basis. Please submit written comments to dora_dpo_rulemaking@state.co.us by April 23, 2024, however the Board will continue to accept written comments until the Rulemaking Hearing on May 23, 2024. Written comments will be posted on the Board’s website under the “Public Notices” tab as received for all stakeholders to access and review.

Rulemaking Hearing - August 17, 2023

The Colorado Medical Board held a Rulemaking Hearing on August 17, 2023 to consider a proposed new Rule 1.32 to adopt Colorado Senate Bill 23-190 (Concerning Policies to Make Punishable Deceptive Actions Regarding Pregnancy-Related Services); the proposed revisions to Rule 1.15 to implement Colorado Senate Bill 23-083 (Concerning an Expansion of a Physician Assistant's Ability to Practice, and, in Connection Therewith, Changing the Relationship between a Physician Assistant and a Physician or Podiatrist from Supervision to Collaboration); the proposed repeal of Rule 161 to implement Colorado Senate Bill 23-188 (Concerning Protections for Accessing Reproductive Health Care); and the proposed repeal of Rule 162 to implement Colorado Senate Bill 23-265 (Concerning a Prohibition on a Regulator Imposing Discipline Against a Person Based on Certain Activities Involving Marijuana).

Stakeholder Meeting - Implementation of HB23-1071 - July 17, 2023

The State Board of Psychologist Examiners in collaboration with the Colorado Medical Board held a virtual Stakeholder Meeting on July 17, 2023. The purpose of this Stakeholder Meeting is for the State Board of Psychologist Examiners (“Psychology Board”) to receive feedback regarding the draft rules to implement House Bill 23-1071 (Concerning the Authority of a Licensed Psychologist to Prescribe Psychotropic Medication for the Treatment of Mental Health Disorders).

Permanent and Emergency Rulemaking Hearing - May 18, 2023

The Colorado Medical Board will hold a Permanent and Emergency Rulemaking Hearing to allow stakeholders a final opportunity to provide testimony before the Board considers adopting the proposed changes to the Colorado Medical Board’s Rule 100 regarding licensing examinations and the reorganization of the Board’s current Rules into a single CCR number (3 CCR 713-1) in the Colorado Code of Regulations instead of having each Board Rule being housed in a separate CCR number to make the Rules easier to navigate. The Board will consider whether to adopt the proposed revisions to Rule 100 on an emergency basis.
